NWA Secures Ruling Ordering Advancement in Favor of Client Mark Griffis

On September 23, 2026, Nagy Wolfe Appleton LLP, together with Baird Holm LLP, secured a ruling in Nebraska state court on a motion for judgment on the pleadings ordering Knowledge Management Systems to advance fees and expenses to its former owner and manager, Mark Griffis, in a Delaware tax dispute. The decision marks perhaps the first ruling on advancement in Nebraska jurisprudence.
The decision demonstrates that advancement rights can be vindicated expeditiously even outside of Delaware. As many state courts do in advancement disputes, the Court treated Delaware jurisprudence as highly persuasive. And even though Nebraska law does not provide for the sort of expedited advancement proceedings available in Delaware, it only took some four months from the filing of the complaint for the Court to order advancement.
